эк. тр., юр., амер. сенатская комиссия по вопросам труда и общественного благосостояния* (сформулировала положение о том, что в 60-е гг., в частности когда был принят закон "О гражданских правах" 1964 г., проблема дискриминации в сфере трудовых отношений виделась как совокупность изолированных проявлений типичных случаев дискриминации; это заставило выделить в американском законодательстве следующие основные формы дискриминации: дифференцированное отношение (disparate treatment), сохранение в настоящем последствий прошлой дискриминации (perpetuation of the effects of past discrimination), экономически необоснованные действия, препятствующие найму (adverse impact not justified by business necessity), отказ принимать на работу представителей религиозных меньшинств (religious accommodation))
